Terms of Service

1. Acceptance of Terms

By accessing fortem.dev, joining the waitlist, or installing the Fortem software, you agree to be bound by these Terms of Service and our Privacy Policy. If you do not agree, do not use the Service. These Terms apply to the hosted website (fortem.dev), the waitlist, discovery call scheduling, and any future managed cloud offering. They do not govern your use of self-hosted Fortem software within your own infrastructure — that is governed by the applicable software license.

2. The Service

Fortem is an AI-native Internal Developer Platform distributed as a self-hosted Helm chart for Kubernetes clusters. Cybrix, LLC provides:

• The Fortem software and Kubernetes operator (open-source and/or commercial license depending on tier)
• The fortem.dev marketing website and documentation
• Waitlist and early access enrollment
• Discovery call scheduling and sales support
• Managed cloud offering (future — separate agreement when available)

3. Self-Hosted Software

When you install Fortem in your Kubernetes cluster, you operate the software on your own infrastructure. Cybrix, LLC:

• Does not have access to your cluster, workloads, or data
• Does not warrant that the software is error-free or uninterrupted
• Is not responsible for data loss, security incidents, or infrastructure failures within your environment
• Provides the software "as-is" under the applicable license terms

4. Waitlist & Early Access

Joining the waitlist does not create a contractual obligation on either party. We reserve the right to accept or decline waitlist applicants at our discretion. Early access terms, including any discounts or commitments, will be communicated separately in writing.

5. Acceptable Use

You agree not to:

• Use fortem.dev or the Service for unlawful purposes
• Attempt to gain unauthorised access to our systems
• Misrepresent your identity or affiliation when contacting us
• Use the Fortem software to violate third-party infrastructure policies or cloud provider terms

6. Intellectual Property

The Fortem name, logo, and website content are the property of Cybrix, LLC. The Fortem software is distributed under its applicable license (see the GitHub repository for details). Nothing in these Terms grants you the right to use Cybrix or Fortem trademarks without prior written consent.

7. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED. CYBRIX, LLC DISCLAIMS ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. We do not warrant that the Fortem software will operate without errors, that it will be compatible with your specific Kubernetes environment, or that any particular feature will be available by a specific date.

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, CYBRIX, LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF DATA, LOSS OF PROFITS, OR INFRASTRUCTURE COSTS, ARISING FROM YOUR USE OF THE SERVICE OR DREVO SOFTWARE. Our total liability for any claim arising from these Terms shall not exceed USD $100.

9. Governing Law

These Terms are governed by the laws of the State of Wyoming, United States, without regard to conflict of law principles. Any disputes shall be resolved in the courts of Natrona County, Wyoming.

10. Changes to Terms

We may update these Terms from time to time. Material changes will be communicated to waitlist subscribers via email. Continued use after changes constitutes acceptance.
